If over 10 schools have subscribed to the helpline in your ‘family’, the cost per school would be discounted by 15%.

Terms and Conditions

  • The Solutions for Schools legal helpline is available from 8.00am to 6.00pm, Monday to Friday, both within and outside of term time.
  • The helpline can be used for advice on any issue or area of law up to 20 minutes per matter (which includes your call).
  • If your query cannot be dealt with within 20 minutes, we will provide you with a fixed fee quote for dealing with your query based on a discounted rate. You will not incur any additional costs without your express instructions to do so.
  • The times you can use the helpline for separate issues are unlimited but the helpline cannot be used for continued advice on the same matter.
  • Upon confirmation of instructions, the package will operate for the remainder of the academic year.
  • These terms and conditions are in addition to Taylor & Emmet terms and conditions.

Through our three separate subscription packages, schools can properly budget for all their on-going legal requirements and be assured they have the legal support and assistance they need. You can choose the level of legal support you need and tailor it to your budget and anticipated use. A legal support subscription package can be taken out in conjunction with our Legal Helpline.

Designed to give a flexible and cost controlled service but without any compromise on quality, each package offers an agreed level of legal support with flexibility to obtain additional advice at discounted rates. We also have a range of additional services which closely relate to the issues which you may typically face (see below).

You can choose the level of support according to your budget and anticipated use. Be reassured that you have an agreed level of support at fixed prices but with the flexibility to buy additional support at discounted rates should you need it.

Any optional extras are not automatically included in the packages but can be added on where required or provided for separately with a fixed cost given wherever possible.

Occupational health referrals– We can assist in managing absence or other health issues of your employees.

Mediation services– Assistance to rescue difficult relationships before it leads to resignations or tribunal claims through a specialist coach and workplace mediator who has experience of working in the education sector.

The total amount of each subscription package is payable immediately.

Any school can apply to become an academy

The Academies Act allows any school to apply to become an academy. We can provide legal advice and support in the following areas:

  • Establishing the academy trust and creating the memorandum and articles of association.
  • Preparing a funding agreement.
  • Preparing the asset transfer agreement.
  • Securing the transfer of land and buildings presently used by the school to the academy trust.
  • Ensuring TUPE is complied with when transferring staff employment contracts to the academy trust in accordance with Transfer of Undertakings (Protection of Employment) requirements.

    10 things you might want to know


    1. Do staff and parents have a say in deciding to convert to an academy?

    Technically the answer is no because it is the governing body which decides whether your school should become an academy although we strongly recommend that this decision should only be made after proper consultation with staff and parents.


    2. What is the role of the academy trust?

    The academy trust is a company limited by guarantee and is the body responsible for running the academy. It comprises of members whose focus is on strategy and directors who are responsible of the day to day running of the academy.


    3. What are the governors’ roles in an academy?

    Ordinarily your existing governors will become directors of the academy trust. Governors should bear in mind that as directors, they have legal duties as provided for in the Companies Act 2006 including an obligation to exercise reasonable care, skill and diligence and promote the success of the company. Governors could also be liable to corporate manslaughter charges if a fatal accident occurred for which the school was responsible.


    4. What is the funding agreement?

    This is an agreement which will be entere

    d into between the department for education and the academy trust which specifies how the academy will operate. The agreement refers to the date when the academy will open and stop being maintained by the local authority.

    5. What needs to be transferred from our existing school to the academy?

    Land/assets, employees and contracts will have to be transferred. Most of these will be transferred from the local authority/land owner although some may also have to be transferred from the governing body. A commercial transfer agreement must be entered into between the academy trust, the governing body and the relevant local authority.


    6. If the local authority transfer the land and buildings occupied by the school, do they retain any liabilities for that land and buildings?

    Once you have converted to an academy and the local authority has transferred the land and buildings to you, all liabilities for such things as repairs will pass to the academy.


    7. What happens to the teachers and other staff once we have converted to an academy?

    All teachers and other staff will transfer to the academy so that their employer becomes the academy trust. The transfer will be subject to “TUPE” requirements. The governors should bear in mind that the academy will become financially liable for employment disputes existing at the time of transfer unless the local authority provide appropriate indemnities.


    8. Our school does not presently have a business manager; do we need one?

    It is almost certainly the case that you will have to appoint a business manager prior to conversion.


    9. Will the local authority have any influence over the conversion process?

    The local authority has no authority to interfere although once you have converted you are still at liberty to buy services if you wish to do so.


    10. Has the government provided any advice on conversion to an academy?

    Yes. You can find a range of information and guidance on the process of becoming an academy on the department for education website.
